Legislative Updates
NLRB Releases New Joint Employer Rule
By CCHRA Legislative Chairperson, Jennifer Ermilio, Esq., Stevens & Lee
On October 27, 2023, the National Labor Relations Board (“NLRB”) released a new rule which will make it easier to find joint employer status and create increased liability for a co-employer’s unfair labor practices. The new rule will take effect on December 26, 2023.
Under the new rule, two entities will be considered joint employers if they share or co-determine the employees' essential terms and conditions of employment, such as wages, benefits, work hours, hiring, terminations, discipline, supervision, and direction. The prior standard required the entity to have direct and immediate control over the essential terms and conditions of the employee’s employment. However, under the new standard, indirect control would be sufficient, even if the entity never exercises a contractual right to exert that indirect control.

CCF hosted 62 students in grades 9-12 from our four districts: Coatesville, Oxford, Kennett, and Phoenixville. The students had the opportunity to tour the campus, learn from Lion Ambassadors, have lunch, and engage with 27 colleges and universities.
The day was filled with energy as students explored what post-secondary success might be like for them!
